In the last decade, live-in relationships law in India has evolved with changing societal attitudes. Live-in relationships, once frowned upon, are now becoming common as society becomes more permissive and less judgmental. However, before entering a live-in relationship, it is important to understand its legal status in India.
Live-in relationships are those relationship usually of different genders, who cohabit together without wedlock. Now, on to the legal status of such a relationship.
Legal Recognition: A Turning Point in 2010
India does not have any specific laws that directly address a live-in relationship. In 2010, the court legally recognized live-in relationships while discussing the safety of women in such relationship.
The first & foremost requirement is that both the boy and girl should be at least 18 years of age. More importantly the girl must be 18+ years of age, otherwise parents of girl can charge the boy with kidnaping, Rape etc. Allahabad High Court said in a case of live-in relationship of a girl below 18 years of age, that she cannot be in a live-in relationship and this act would be an immoral & illegal act.

Safeguarding Relationships: The Role of Live-In Agreements
It is advisable for live-in couples to draft an agreement or contract. This helps avoid future complications. The process consists of Affidavits of boy & girl stating their relevant personal information and an agreement/ contract on a 100 INR stamp paper, signed by both parties.
The contract will secure boy of the allegations of kidnap, rape etc. and secure girl from domestic violence. Because of contract, she can complain under Domestic Violence Act, if subjected to violence, if the live-in relationship is continuous for a reasonably long time. Also, the girl can sue for Maintenance under Domestic Maintenance and Support System (DMSS) in such circumstances. this contract/ agreement can be mutually terminated anytime.
Societal Perceptions and Personal Choices in Live-In Relationships
So, friends tread with extreme caution while entering live-in relationship. Remember, when the tide turns and relationship stumble upon an obstacle, you (specially if you are a girl) will be all alone to fight your battles. Be strong & confident in such situation.
If need be, do not hesitate to take help from a reliable friend or a person of integrity or a legal Authority. You may also like reading Rights of Women in India.
